The Executive Council listened, and item 15, the Dartmouth Hitchcock contract, was tabled. This got the attention of the Attorney General, who indicated he would handle it. I’m hoping to have an update (hopefully a win) for you all by next week.

Currently, every parent has access to the physical, paper, document of their child’s medical records. However federal law requires a child over the age of 12 years old have access to addiction services and birth control without parental consent and NH state law requires they have access to STD treatment without parental consent. If you received your child’s medical records, those treatments would be redacted.
If you have a child over the age of 12, you probably have noticed that you lost access to their online medical portals. The medical system claims that the portals aren’t designed to redact these treatments the child can get without parental consent and therefore, to stay legally compliant, they simply cut out the parent.
This bill seeks to require that parents retain access to their children’s full medical records, including portal access, until the age of 18.
I do object to section (c) listed below:
(c) When a health care provider has determined by clear and convincing evidence based upon articulable facts that disclosure of the records to a parent or legal guardian of a minor child is likely to result in abuse or neglect. A health care provider who makes this determination shall document in the medical record of the minor child all facts upon which he or she relied in making the determination.
Only a judge may remove a parent’s rights after due process. Health care providers do not and should not have this ability. They are mandatory reporters and if they at all suspect abuse for any reason, they should report the parent.

This bill requires that all parents or educators involved in the education of any child who receives an educational tax credit, grant, or scholarship from the state get a background check. It also applies to all educators and parents involved in any group situation that accepts this type of funding. That means if you go to a homeschool co-op, even if you do not receive any type of funding, but another parent in the same group does, you will also be obligated to have a background check.
This bill is an attack on the parents of this state and should be immediately rejected.

This bill is a simple repeal of the New Hampshire Vaccine Association. Most people don’t realize this, but all vaccines in NH are purchased by this quasi-public organization and providers have to purchase the vaccines from this organization. It’s operations have been historically shady and there is no reason for its existence other than keeping the state in the vaccine purchasing business. Most states do not have such an organization.

Many people in the state enjoy the reduced costs and often superior care of direct payment or membership based primary care. But direct payment and membership based models are not currently allowed for hospitals and clinics. This bill seeks to open up this free market option for hospitals and clinics.
